Terms & Conditions

1. General Overview

Welcome to Aman Al-Bilad Systems. By accessing our website or using any of our IT services, solutions, or software, you are agreeing to comply with and be legally bound by the following Terms and Conditions. These terms apply to all visitors, users, and clients engaging with us for any reason, whether it’s browsing our website, purchasing a service, or entering into a long-term project contract. If you do not agree with any part of these terms, you must discontinue use of our services and website immediately.

Aman Al-Bilad Systems is a registered software house offering a wide range of IT services including but not limited to web development, mobile app development, software engineering, UI/UX design, IT consultancy, technical support, maintenance services, and tailored enterprise software solutions. Our services may be offered through one-time projects, ongoing contracts, or subscription models, depending on the needs and nature of each client relationship.
These Terms form a legally binding agreement between you (as an individual or business entity) and Aman Al-Bilad Systems, and will govern any interaction you have with us unless otherwise agreed in a signed document or service-level agreement (SLA).

2. Use of Services and Conduct

When you engage with our services or access our platforms, you agree to use them solely for lawful purposes. You shall not misuse, exploit, reverse-engineer, resell, or damage any of the software, tools, or intellectual property provided by Aman Al-Bilad Systems. You are responsible for maintaining the confidentiality of access credentials (if applicable), ensuring that your usage does not violate any local, national, or international laws.
Our services are intended for users aged 18 and above. By using our services, you confirm that you meet the legal age of majority in your region. If you are entering into an agreement on behalf of a company, you warrant that you have the authority to do so.

For project-based work, clients are responsible for providing necessary materials, documentation, access credentials, and timely approvals. Any delays in client feedback or response can affect the project timeline and may result in additional charges or rescheduling. You also acknowledge that certain delays—especially during the development or testing phases—may affect final delivery dates, and Aman Al-Bilad Systems will not be held responsible for missed deadlines due to client-side inaction.

You must not transmit any harmful content, such as viruses, trojans, or malicious code. Any such action will result in immediate termination of services and may lead to legal action.

3. Intellectual Property and Confidentiality

All content, source code, architecture, documents, databases, branding elements, and designs created by Aman Al-Bilad Systems remain the intellectual property of the company unless otherwise stated in a written and signed contract. Clients may be granted a non-exclusive, non-transferable license to use the deliverables solely for their internal business needs. You may not resell, distribute, or rebrand any of our intellectual property without explicit permission.
We take confidentiality seriously. Both parties agree to keep any proprietary or sensitive business information confidential and not disclose it to third parties without prior consent. This includes, but is not limited to, business models, financial data, client lists, passwords, source code, technical documentation, project-related communication, and any other non-public material. This obligation survives the end of any business relationship.
If the client provides third-party materials, they warrant they have the legal right to do so. Aman Al-Bilad Systems will not be responsible for any copyright infringement claims arising from the use of such materials.

4. Payments, Invoicing, and Refunds

All services are subject to charges as outlined in the mutually agreed-upon proposal, invoice, or contract. Payments must be made on time, as per the schedule defined in our agreement. Common payment structures include:
Initial Deposit: A non-refundable advance (usually 30–50%) is required before work begins.
Milestone-Based Payments: In long-term projects, payments are divided by phases or deliverables.
Subscription Billing: For services like monthly support or maintenance, recurring payments are invoiced on a fixed schedule.
Late payments may incur interest fees, delay project work, or result in suspension of services. All bank charges, processing fees, and currency conversion costs (for international clients) are to be borne by the client.
Refunds are issued only under special circumstances, and partial or full refunds may be considered only if the work has not yet started, or a significant delay or failure has occurred on our part. Refunds are not applicable for services that are already rendered, licenses that are activated, or digital deliverables that are handed over.

Aman Al-Bilad Systems reserves the right to suspend or terminate service delivery in case of non-payment, breach of contract, or inappropriate behavior by the client.

5. Limitation of Liability and Disclaimer

While we strive to deliver high-quality, error-free solutions, all services are provided on an “as-is” and “as-available” basis. We make no warranties or guarantees—express or implied—regarding the performance, security, or results of our services unless explicitly stated in a contract.
To the fullest extent permitted by law, Aman Al-Bilad Systems shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to:

  • Loss of profits or revenue
  • Downtime or business interruption
  • Data corruption or loss
  • Costs incurred due to rework or third-party disputes

In any case, our total liability shall not exceed the total amount paid by you to us for the specific service in dispute. You agree that any claims or disputes must be raised within 30 days of the issue arising and resolved through communication before pursuing legal action.

We are also not responsible for failures or issues caused by:

  • Hosting/server outages
  • Third-party plugins, APIs, or services
  • Force majeure events such as natural disasters, political unrest, or internet outages

6. Termination and Governing Law

Either party may terminate a service contract with written notice under the terms of that agreement. Termination does not absolve either party from obligations already accrued—such as pending payments or confidentiality commitments.

Aman Al-Bilad Systems reserves the right to immediately suspend or terminate services if a client violates any part of these Terms, engages in illegal activity, fails to make timely payments, or behaves in a manner that is abusive, fraudulent, or disruptive.
These Terms shall be governed and interpreted under the laws of [Insert Country], and any disputes shall be resolved under the jurisdiction of the courts of [Insert City/Region]. Any formal legal action must be preceded by a good-faith attempt at resolution through mutual discussion.

7. Final Provisions
These Terms & Conditions represent the entire agreement between you and Aman Al-Bilad Systems, superseding any prior oral or written understandings unless a formal, signed agreement exists. Any waiver of rights or enforcement delays shall not be considered a permanent relinquishment of rights.

We may update or revise these Terms at any time, with or without notice. The most recent version will always be available on our website. Your continued use of our services constitutes your acceptance of any such changes.

If any provision of these Terms is found to be unenforceable, the remainder will remain valid and enforceable to the fullest extent permitted by law.
